Effective Judicial Notification through electronic registration on Blockchain

The application of distributed ledger technology, particularly through NFTs, stands out as an effective tool for electronic notification due to its immutability, transparency and security. A significant case in the United Kingdom exemplifies this application, where a law firm obtained court approval to use an NFT on a blockchain to notify alleged perpetrators of a cryptocurrency theft crime, expediting the judicial process by summoning alleged fraudsters who previously remained anonymous.

In the United States, since 2022, an increase in the use of NFTs has been observed to notify defendants in blockchain-related cybercrime cases, allowing previously untraceable alleged perpetrators to be reached. This phenomenon reflects a global trend of increase in computer crimes, including the theft of crypto assets, as evidenced by data from the Spanish Ministry of the Interior that registers an increase in computer fraud.

Foreign courts have turned to technology used by cybercrime perpetrators, such as NFTs, to overcome obstacles in judicial service and ensure effective receipt of indictments by defendants, thereby addressing defendant defenselessness and other jurisdictional and communication challenges. An example of this is the case of a federal judge in the United States who sent a judicial notification through blockchain and NFT, after the presentation of an expert report that confirmed illicit cryptocurrency transactions.

NFTs, derived from the evolution of cryptographic tokens, are unique and indivisible, allowing them to serve as publicly verifiable certificates. Blockchains, being distributed, encrypted and public, are ideal for applying exact timestamps, guaranteeing the integrity of content and authenticating senders and recipients in communications.

In short, distributed ledger technology, together with NFTs, offers an efficient and legally sound solution for judicial service in the digital era, aligning with the principles of authenticity and protection of fundamental rights. This innovative approach contributes to improving the effectiveness and legitimacy of the judicial system in an increasingly digitalized context.
