Introduction: The crossroads of digital law and autonomous agents
The emergence of autonomous agents in the technological sphere not only transforms our way of interacting with advanced systems, but also challenges the ethical, legal and regulatory foundations on which our society is built. These tools, which go beyond simple predefined commands to make autonomous decisions, generate extraordinary opportunities in areas such as justice, finance and security, but they also expose legal loopholes and ethical dilemmas that require urgent attention.

This text will be structured into THREE CHAPTERS (this being 0/1) that address, from different perspectives, the challenges posed by the growing implementation of autonomous agents. Each chapter is designed to delve into specific aspects of this transformation, offering analysis, concrete examples, and proposals toward a comprehensive regulatory framework.

In Chapter 1, we will analyze the issue of RLEGAL RESPONSIBILITY in the use of autonomous agents. Who should bear the consequences when these systems make mistakes or cause damage? We will explore different perspectives on the allocation of responsibility, from developers to end users, and present regulatory proposals, such as mandatory insurance and compensation mechanisms, that could bring clarity to this challenge. This chapter also introduces the impact of these systems on areas such as justice and finance, providing concrete examples from 2024 that illustrate the magnitude of the problem.

For its part, Chapter 2 will focus on two other fundamental challenges: the mitigation of SESG and the protection of PRIVACY and SECURITY. Through recent cases, we will see how autonomous agents, by relying on historical data, can perpetuate social prejudices and structural inequalities.

Likewise, we will discuss the vulnerabilities that these systems generate in a massive data environment, exposing risks of discrimination and privacy violations. That chapter will propose practical strategies, such as regular audits, algorithmic transparency and specialized supervision, to address these issues.
This text does not limit itself to exposing the problems, but seeks to offer a comprehensive reflection on how to move towards an ethical and regulatory framework that allows taking advantage of the full potential of autonomous agents in a fair and responsible manner. The purpose is to invite legislators, technologists, jurists and society in general to participate in the construction of a balanced digital ecosystem, where technological innovations are aligned with the fundamental values of equity, justice and transparency.
