A starting point that Europe has tried to disguise<\/strong><\/p>\n<p id=\"ember50\" class=\"ember-view reader-text-block__paragraph\">In 2024, Europe celebrated the approval of the AI Act as if it had marked a before and after. The story was simple: ethical leadership, citizen protection and regulation that the world would admire.<\/p>\n<p id=\"ember51\" class=\"ember-view reader-text-block__paragraph\">The reality has been different. While speeches were being made:<\/p>\n<ul>\n<li>The EU barely caught <strong>10%<\/strong> of global investment in AI in 2024-2025.<\/li>\n<li><strong>USA<\/strong> concentrated the <strong>65 %<\/strong>.<\/li>\n<li><strong>Asia<\/strong>, he <strong>25 %<\/strong>.<\/li>\n<li>European startups in critical sectors\u2014healthcare, fintech, automation\u2014moved directly to the US so they could operate without lockdowns.<\/li>\n<li>Mistral AI, one of the few companies with global ambition born in Europe, opened a headquarters in San Francisco to grow.<\/li>\n<\/ul>\n<p id=\"ember53\" class=\"ember-view reader-text-block__paragraph\">It is not a problem of \u201ccomplying\u201d or not complying. It&#8217;s a design problem: <strong>The framework created to protect has raised a wall that only Big Tech can climb<\/strong>.<\/p>\n<p id=\"ember54\" class=\"ember-view reader-text-block__paragraph\">And this brings us to the second piece of the board.<\/p>\n<p id=\"ember55\" class=\"ember-view reader-text-block__paragraph\"><strong>II. Before resolving the AI Act, Europe has already activated another process: the Digital Omnibus<\/strong><\/p>\n<p id=\"ember56\" class=\"ember-view reader-text-block__paragraph\">At the end of 2025, the European Commission has promoted what it calls <strong>Digital Omnibus<\/strong>: a package of coordinated reforms to \u201csimplify\u201d the European digital ecosystem, including:<\/p>\n<ul>\n<li>adjustments to AI Act,<\/li>\n<li>modifications to the RGPD,<\/li>\n<li>ePrivacy review,<\/li>\n<li>consistency with DORA,<\/li>\n<li>and harmonization with MiCA and DMA.<\/li>\n<\/ul>\n<p id=\"ember58\" class=\"ember-view reader-text-block__paragraph\">The formal presentation is scheduled for <strong>November 19, 2025<\/strong>, although much of the content is already circulating in drafts and leaks.<\/p>\n<p id=\"ember59\" class=\"ember-view reader-text-block__paragraph\">The official message is \u201csimplification.\u201d The political effect is different: <strong>recognize that the current European digital framework does not work coherently<\/strong>. And this confirms what the market has perceived for a year.<\/p>\n<p id=\"ember60\" class=\"ember-view reader-text-block__paragraph\"><strong>III. Europe does not have a specific problem: it has four simultaneous fractures<\/strong><\/p>\n<p id=\"ember61\" class=\"ember-view reader-text-block__paragraph\"><em>1. Regulatory fracture: too many rules without coordination<\/em><\/p>\n<p id=\"ember62\" class=\"ember-view reader-text-block__paragraph\">AI Act, RGPD, MiCA, DMA, DORA and sectoral regulation form a system that was never designed to coexist.<\/p>\n<p id=\"ember63\" class=\"ember-view reader-text-block__paragraph\">Clear examples:<\/p>\n<p id=\"ember64\" class=\"ember-view reader-text-block__paragraph\"><strong>Medical diagnosis with AI <\/strong>\u2013 AI Act requires large and representative datasets. \u2013 RGPD requires strict minimization. The company must <strong>maximize and minimize<\/strong> both.<\/p>\n<p id=\"ember65\" class=\"ember-view reader-text-block__paragraph\"><strong>Biometrics <\/strong>The same fingerprint may be ultra-sensitive data or not be \u201chigh risk,\u201d depending on the use.<\/p>\n<p id=\"ember66\" class=\"ember-view reader-text-block__paragraph\"><strong>Finance <\/strong>\u2013 AI Act: high risk. \u2013 RGPD: mandatory human intervention. \u2013 DMA: interoperability. \u2013 Financial supervisors: statistical validation.<\/p>\n<p id=\"ember67\" class=\"ember-view reader-text-block__paragraph\">The European Parliament has already admitted it: <strong>\u201clack of coordination, duplication of costs and contradictory criteria\u201d<\/strong>.<\/p>\n<p id=\"ember68\" class=\"ember-view reader-text-block__paragraph\">The Digital Omnibus tries to correct part of the problem, but it reveals a bigger one: <strong>Europe legislated before building an institutional architecture capable of sustaining that level of regulation.<\/strong><\/p>\n<p id=\"ember69\" class=\"ember-view reader-text-block__paragraph\"><em>2. Economic fracture: European costs impossible to compete<\/em><\/p>\n<ul>\n<li>Complying with the AI Act at high risk costs <strong>\u20ac500,000 \u2013 2 million<\/strong>.<\/li>\n<li>EU 2025 aggregate impact: <strong>10.9 billion<\/strong>.<\/li>\n<li>Result: <strong>90% of the European GPAI market in the hands of US companies<\/strong>.<\/li>\n<\/ul>\n<p id=\"ember71\" class=\"ember-view reader-text-block__paragraph\">The Digital Omnibus does not eliminate this imbalance. It only proposes partial and temporary relief for mid-caps and startups. It does not resolve the underlying asymmetry.<\/p>\n<p id=\"ember72\" class=\"ember-view reader-text-block__paragraph\"><em>3. Temporal fracture: calendars that do not coincide with reality<\/em><\/p>\n<ul>\n<li>High risk obligations: August 2026.<\/li>\n<li>Technical standards: Q2 2026, in the best scenario.<\/li>\n<li>Notified bodies: most undesignated.<\/li>\n<li>Regulatory guides arriving <strong>after<\/strong> to come into force.<\/li>\n<\/ul>\n<p id=\"ember74\" class=\"ember-view reader-text-block__paragraph\">The Digital Omnibus contemplates delays and clock-stops. But not because Europe wants to be flexible, but because <strong>does not arrive on time<\/strong>.<\/p>\n<p id=\"ember75\" class=\"ember-view reader-text-block__paragraph\"><em> 4. Global fracture: Europe competes alone<\/em><\/p>\n<ul>\n<li>USA: light regulation and rapid adaptation.<\/li>\n<li>China: strict control + <strong>50,000 million in subsidies<\/strong>.<\/li>\n<li>Europe: rigid regulation + <strong>zero equivalent subsidies<\/strong>.<\/li>\n<\/ul>\n<p id=\"ember77\" class=\"ember-view reader-text-block__paragraph\">Founding models in 2025: \u2013 Europe: 3 \u2013 USA: 40 \u2013 China: 15<\/p>\n<p id=\"ember78\" class=\"ember-view reader-text-block__paragraph\">It is not a temporary problem: it is structural.<\/p>\n<p id=\"ember79\" class=\"ember-view reader-text-block__paragraph\"><strong>IV. The flexibility of the AI Act announced by the press is not a reform: it is a recognition<\/strong><\/p>\n<p id=\"ember80\" class=\"ember-view reader-text-block__paragraph\">The leaks (FT, Reuters, Tech Policy Press) note:<\/p>\n<ul>\n<li>delay in sanctions,<\/li>\n<li>exemptions for medium-sized<\/li>\n<li>GPAI flexibility,<\/li>\n<li>clock-stop at high risk.<\/li>\n<\/ul>\n<p id=\"ember82\" class=\"ember-view reader-text-block__paragraph\">The Digital Omnibus is the formal way to introduce these adjustments. But its origin is clear: <strong>Europe has realized that the rule, as it stands, is not sustainable in practice<\/strong>. Uncertainty, however, continues to grow: each leak generates paralysis. And the absence of clear political communication amplifies the feeling of improvisation.<\/p>\n<p id=\"ember83\" class=\"ember-view reader-text-block__paragraph\"><strong>V. What really works in 2025\u20132028?<\/strong><\/p>\n<ol>\n<li><strong>Smart defensive rating <\/strong>Prevent systems from \u201cfalling\u201d into high risk by default.<\/li>\n<li><strong>Avoid open-source without contractual traceability <\/strong>Especially until 2027.<\/li>\n<li><strong>Document automation from CI\/CD <\/strong>It&#8217;s not optional: it&#8217;s the only way to resist simultaneous audits.<\/li>\n<li><strong>Active use of national sandboxes <\/strong>Spain, Germany and France are acting as regulatory decompression zones.<\/li>\n<li><strong>Honest communication to investors<\/strong><\/li>\n<\/ol>\n<p id=\"ember85\" class=\"ember-view reader-text-block__paragraph\"><em>\u201cWe are aligning evolving standards with traceable documentation from the pipeline\u201d<\/em>. In an unstable environment, this message builds trust.<\/p>\n<p id=\"ember86\" class=\"ember-view reader-text-block__paragraph\"><strong>VI. Who is executing, not improvising<\/strong><\/p>\n<p id=\"ember87\" class=\"ember-view reader-text-block__paragraph\">This point is important.<\/p>\n<p id=\"ember88\" class=\"ember-view reader-text-block__paragraph\">Few organizations work at the real intersection of legal, technical and operational. Europe needs clarity, not more layers of regulation<\/strong><\/p>\n<p id=\"ember93\" class=\"ember-view reader-text-block__paragraph\">The AI Act was born from a legitimate political conviction. The Digital Omnibus was born from an urgent institutional need. But a continent does not stand on principles alone. You need consistent rules, realistic timetables and regulators that talk to each other.<\/p>\n<p id=\"ember94\" class=\"ember-view reader-text-block__paragraph\">If the Digital Omnibus remains in minor adjustments and not in a fundamental reform, Europe will prolong its uncertainty until the end of the decade. Meanwhile, companies can&#8217;t wait for Brussels to get its act together.<\/p>\n<p id=\"ember95\" class=\"ember-view reader-text-block__paragraph\">The only sensible strategy is to prepare for the most realistic scenario: <strong>a partially corrected, partially diluted AI Act and applied by authorities who will continue to interpret it unevenly for years<\/strong>.<\/p>\n<p id=\"ember96\" class=\"ember-view reader-text-block__paragraph\">Whoever adapts to that scenario will be able to compete.
