What is worrying is that, despite its omnipresence, it is too often confused with something it is not: a futuristic extension of data governance. This seemingly minor misconception is preventing many organizations from adequately addressing the real risks of AI.

Because it is one thing to manage data, and quite another to govern autonomous systems capable of making decisions with structural impact. And that requires assuming that AI has brought with it an additional layer of complexity, which cannot be resolved by applying traditional data governance frameworks.

First confusion: “we already have data policies, that covers AI”

In too many organizations, especially in the financial and healthcare sectors, the idea is that if data is well governed, then everything AI does will be too. But the problem is not just what data AI uses, but what it does with it.

For example, a bank may have excellent control over its customer data, from credit profiles to payment history. But if an AI system automates the granting of mortgages and ends up systematically rejecting certain socioeconomic profiles—without anyone knowing why—we are not facing a data problem, but rather one of algorithmic governance. And there, the answer is no longer technological: it is legal, ethical and organizational.

Second confusion: “thinking that it only impacts IT”

AI governance is not a technical issue locked away in an IT department. It directly affects areas such as human resources, marketing, regulatory compliance, general management, and even collegiate bodies.

Let’s imagine an HR department that uses AI to do automated resume screening. Even if the data is encrypted and stored in accordance with GDPR, if the model systematically excludes women over 50 years of age, we are facing a structural bias. Who detects it? Who corrects it? Who answers? This is not a question for the computer scientist. It is a question for the entire organization.

Third confusion: “governing AI is supervising data”

Data governance frameworks, as we well know, are designed to answer key questions: who owns the data? How is it stored? What standards apply to its sharing? Is it trustworthy and compliant?

All this is essential.

But AI requires other types of questions:

* How is the model trained and with what criteria?
* Who validates the results?
* How is their behavior audited?
* What mechanisms are there to correct an automated failure in real time?

When an insurer uses AI to set differentiated premiums without even the CEO knowing how it does it, we are not dealing with a data governance problem.

We are facing an uncontrolled delegation of power.

RIA: the European turning point

The Artificial Intelligence Regulation of the European Union (RIA), in force since August 2024, is based precisely on this distinction. It does not confuse AI governance with data protection, but rather creates a specific framework of obligations for the design, deployment and monitoring of AI systems, especially in high-risk contexts.

The EU has understood that AI is not limited to operating on data: it operates on people, rights, decisions and structures. And therefore, it must be subject to principles such as transparency, explainability, accountability and meaningful human intervention.

In short: Managing data well is not enough.

It’s like saying that because a car has good tires, then there is no need to regulate the driver.

AI doesn’t just process information: it acts.

And that is why AI governance cannot be reduced to good data practices. It demands a new framework. A change of mentality.

And, above all, it requires institutional leadership to assume that governing AI is governing the invisible power that today makes decisions without face or signature.

By Antonio Tejeda Encinas , president Euro-American Digital Law Committee ,and META Channel Corp It is not strange that, in…

[1838
1933,1853,1894
post-38597","post","type-post","status-publish","format-standard","has-post-thumbnail","category-cybersecurity-and-digital-resilience","tag-data-protection","tag-digital-governance","tag-privacy-and-data
["GET
