For <\/span><\/span>Latin America<\/span><\/span><\/strong> , this decision raises a crucial dilemma: should the region adopt a model similar to the European one or develop its own framework that balances innovation with the protection of fundamental rights without compromising its competitiveness?<\/span><\/span><\/div>\n<\/div>\n

So far, the region has followed two main trends: the adoption of European-inspired regulations or the lack of clear regulations, leaving the development of AI in a legal vacuum full of uncertainty. However, given its economic context and the absence of a consolidated regulatory infrastructure, Latin America needs a strategic approach that responds to its reality.<\/span><\/span><\/div>\n<\/div>\n

Challenges and Opportunities for Latin America<\/span><\/span><\/h3>\n<\/div>\n

1. Lag in investment and development<\/span><\/span><\/strong><\/div>\n
<\/div>\n
Latin America faces a significant disadvantage in terms of investment in AI compared to the US, China and the EU. Although there are initiatives such as the alliance between Adigital and the IDB to promote technological development, the region still lacks the financing and infrastructure necessary to compete on a global level.<\/span><\/span><\/div>\n<\/div>\n

2. Risk of replicating regulations without adapting them<\/span><\/span><\/strong><\/div>\n
<\/div>\n
The adoption of European regulatory frameworks without considering the cultural, economic and social particularities of the region could lead to ineffective regulations. Latin America needs regulations designed specifically for its context, instead of applying foreign models that do not fit its needs.<\/span><\/span><\/div>\n<\/div>\n

3. Lack of institutional capacity<\/span><\/span><\/strong><\/div>\n
<\/div>\n
The regulation of AI requires specialized organizations and oversight capacity, something that many countries in the region have not yet fully developed. Without a robust framework to oversee the implementation of regulations, any regulation risks remaining on paper without effective enforcement.<\/span><\/span><\/div>\n<\/div>\n

4. Possibility of becoming a ‘regulatory paradise’<\/span><\/span><\/strong><\/div>\n
<\/div>\n
Some countries could opt for minimal regulations to attract investments in AI, which could lead to risks of technological exploitation and lack of protection for citizens. While flexible regulation can be attractive to the private sector, it can also create an environment in which companies operate without adequate accountability mechanisms.<\/span><\/span><\/div>\n<\/div>\n

It’s Time to Define Your Own Path<\/span><\/span><\/h3>\n

The world is redefining the rules of the game in artificial intelligence and Latin America cannot be left out. The withdrawal of the AI Responsibility Directive in the EU confirms that regulating AI is a complex challenge and that each region must find its own approach.<\/span><\/span><\/div>\n<\/div>\n

To do this, Latin America needs:<\/span><\/span><\/div>\n
<\/div>\n<\/div>\n

The question is no longer whether Latin America should regulate AI, but how to do it strategically. The EU’s decision leaves a clear lesson: it is not enough to copy external models, it is time to design our own path.<\/span><\/span><\/div>\n<\/div>\n
